Acceptance of Terms By accessing or using Rhythm AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. ## 2. Description of Service Rhythm AI is a browser-based frontend application that: - Provides a user interface for uploading images or entering text prompts - Connects to third-party AI 3D generation services (specifically Tripo3D) via user-provided API keys - Displays generated 3D models in a Three.js viewer - Allows export of models as GLB files Rhythm AI does **not** operate AI inference servers, does not generate 3D models itself, and does not store user images or generated models. ## 3. User Responsibilities ### 3.1 API Key Security - You are responsible for maintaining the confidentiality of your Tripo3D API key - You are responsible for all activities and charges associated with your API key - You must notify us immediately if you suspect unauthorized use of your key ### 3.2 Acceptable Use You agree not to: - Use the Service for any illegal or unauthorized purpose - Generate content that is infringing, abusive, malicious, or otherwise objectionable - Attempt to reverse-engineer, hack, or exploit the Service - Use the Service to generate models that violate Tripo3D's terms of service - Upload images that you do not own or have permission to use ### 3.3 Age Requirement You must be at least 13 years old to use this Service. If you are under 18, you represent that your legal guardian has reviewed and agreed to these Terms on your behalf. ## 4. Third-Party Services ### 4.1 Tripo3D - The Service uses Tripo3D's API for 3D model generation - Your use of Tripo3D's services is subject to Tripo3D's own Terms of Service and Privacy Policy - Rhythm AI is not affiliated with Tripo3D and does not guarantee the availability, accuracy, or quality of Tripo3D's services - You are responsible for reviewing and complying with Tripo3D's terms ### 4.2 Cloudflare - The Service is hosted on Cloudflare Pages - Your use of the Service is subject to Cloudflare's Terms of Service ## 5. Intellectual Property ### 5.1 Your Content - You retain ownership of any images you upload and any models you generate - By using the Service, you grant Rhythm AI a limited, non-exclusive license to process your content solely for the purpose of providing the Service ### 5.2 Generated Content - You own the 3D models generated through the Service, subject to Tripo3D's licensing terms - You are responsible for ensuring your use of generated models complies with applicable laws and third-party rights ### 5.3 Our Content - The Rhythm AI application, design, code, and branding are owned by Rhythm AI - You may not copy, modify, or distribute the Service without permission ## 6. Privacy - Your source image is sent directly to Tripo3D's servers; it does not pass through our servers - Your API key is stored locally in your browser and is not transmitted to our servers - We do not store, log, or share your images or API keys - For complete privacy information, see our Privacy Policy ## 7. Payments and Credits ### 7.1 Third-Party Billing - All AI generation costs are billed by Tripo3D through your own API key account - Rhythm AI does not charge users for using the Service - Any credits, subscriptions, or payments are between you and Tripo3D directly ### 7.2 Donations - Donations through Ko-fi, PayPal, or GCash are voluntary and non-refundable - Donations do not grant any special rights or access to the Service ## 8. Disclaimers and Limitation of Liability ### 8.1 Service Availability THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE: - That the Service will be uninterrupted, secure, or error-free - That generated models will meet your expectations or requirements - That the Service will be compatible with your browser or device - That errors or defects will be corrected ### 8.2 Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, RHYTHM AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: - Loss of profits, data, or goodwill - Service interruptions or data loss - Cost of substitute services - Any damages arising from your use of the Service or third-party services OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICH IS $0 AS THE SERVICE IS PROVIDED FREE OF CHARGE. ## 9. Indemnification You agree to indemnify, defend, and hold harmless Rhythm AI and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: - Your use of the Service - Your violation of these Terms - Your violation of any third-party rights - Any content you generate or upload through the Service ## 10. Termination We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. ## 11. Your continued use of the Service after changes constitutes acceptance of the updated Terms. ## 12.
